1. What this covers

These terms cover the website mercysf.app, its forum, and the Mercy SF application. Using any of them means accepting them. If you do not accept them, do not use them.

The provider is named in the imprint.

2. The software is free

Mercy SF costs nothing and every feature is available to everyone. There is no licence to buy, no subscription, and no feature reserved for donors. Voluntary donations through Ko-fi are a thank-you and grant no rights, no priority and no additional functionality.

You may use it privately and commercially, and you may run it on as many of your own machines and accounts as you like. You may not sell it, sell access to it, or present it as your own work.

3. The risk to your game account is yours

Mercy SF automates a Shakes & Fidget account through the game's own public interface. It does not modify the game client and it does not exploit defects in the game. It is nonetheless automation, and automating an account may breach the terms of service of Shakes & Fidget and its operator, Playa Games GmbH.

The consequence of that breach, whether a warning, a suspension, a permanent ban or the loss of a character built over years, falls on you and on nobody else. Read the game's own terms and decide for yourself. We cannot restore an account and we will not compensate for one.

Mercy SF is independent software and has no connection to Playa Games GmbH.

4. No warranty

The software is provided as it is, without warranty of any kind: not that it is free of defects, not that it is available, and not that it is fit for any particular purpose. It is developed by one person in their spare time and it will have bugs.

Liability is limited to intent and gross negligence. For simple negligence there is liability only for breach of an obligation whose fulfilment makes proper performance possible at all and on whose observance you may routinely rely, and then only for the foreseeable damage typical of this kind of contract. Liability under the German Product Liability Act, and for injury to life, body or health, is unaffected.

5. Your account on this site

An account is needed only for the forum, for feature voting, and for signing in to the desktop app. One account per person. You are responsible for what happens under it.

You can have your account deleted at any time. Write to the address in the imprint. We may close an account that is used to break these terms.

6. The forum

What you post is yours; you keep the rights to it. By posting you allow it to be shown here, indefinitely, as part of the thread it belongs to.

Do not post: account credentials of any kind, whether yours or anyone else's; material that is illegal where you or we are; advertising; another person's private information; or anything designed to harass a person.

Posts are not checked before they appear. Anything that breaks these rules is removed once we know about it, and the account behind it may be closed. Report a post with the report button, or write to the address in the imprint.

7. Availability and changes

There is no guarantee that the site, the forum or the update server is reachable. Features may change or disappear, and the project may stop.

These terms may be updated when the services or the law change. The version published here is the one that applies. Substantial changes will be announced on the site.

8. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not remove the protection of the mandatory law of the country you live in.
